KYZE Management provides digital growth services including but not limited to:

• Social media marketing (TikTok, Meta, Instagram, LinkedIn)
• Custom website and landing page development
• Business automation and AI-powered systems
• Email and SMS marketing automation
• Video editing and graphic design services

3. Service Agreement

When you engage our services, you agree to:

• Provide accurate and complete information about your business
• Cooperate with our team and respond to requests in a timely manner
• Grant necessary access to platforms, accounts, and assets required for service delivery
• Pay all fees as agreed upon in your service contract
• Comply with all applicable laws and platform policies

4. Payment Terms

• All fees are quoted in U.S. Dollars unless otherwise specified
• Payment terms will be outlined in your service agreement
• Late payments may result in service suspension
• Refunds are subject to our 30-day money-back guarantee policy, as outlined in your service agreement

5. Intellectual Property

All content created by KYZE Management for your business (graphics, videos, copy, etc.) becomes your property upon full payment. However, we retain the right to use anonymized case studies and general results in our marketing materials unless otherwise agreed upon in writing.

6. Client Responsibilities

You are responsible for:

• The accuracy and legality of content you provide
• Compliance with all platform terms of service (TikTok, Meta, Shopify, etc.)
• Product quality, fulfillment, and customer service
• Any legal issues arising from your business operations

7. Results and Performance

While we strive to deliver exceptional results, we cannot guarantee specific outcomes such as revenue targets, follower counts, or conversion rates. Results depend on many factors including product quality, market conditions, platform algorithms, and client cooperation.

8. Limitation of Liability

KYZE Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for services in the past 12 months.

9. Termination

Either party may terminate the service agreement with written notice as specified in your contract. Upon termination:

• You must pay for all services rendered up to the termination date
• We will provide you with all completed work and access credentials
• We are not responsible for ongoing management after termination

10. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the business relationship. This includes business strategies, financial data, customer lists, and trade secrets.

11. Third-Party Services

We may use third-party tools and services to deliver our services (e.g., email platforms, analytics tools, design software). You agree that we are not responsible for the performance or policies of these third-party services.

12. Modifications to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
